1. Introduction
Nagomi Work Life Consulting, a sole proprietorship under Swiss law with its registered office in Zurich, phone: +41 766 0775 68 (hereinafter: "Nagomi Consulting"), would like to help individuals and/or Companies (hereinafter: "you") achieve a healthier lifestyle through coaching and information. The personal and holistic consulting approach creates an important prerequisite for this.
These Terms and Conditions (hereinafter: "T&C") serve to regulate the contractual relationship ("Contract") between you and Nagomi Consulting. This includes and applies to all services and products provided by Nagomi Consulting, all services and communication, email or otherwise, delivered by Dana Riedener, and information set forth on the website (www.Nagomiwork-lifeharmony.com). All of which are aimed to help improve an individual’s life balance, regardless of the medium used (personal coaching, video Conferencing, telephone calls, e-mail, etc.).
2. Disclaimer & Waiver
By purchasing consulting services from Nagomi Consulting, you confirm that you have read and agree to each statement and that you wish to proceed:
- You understand that to purchase Nagomi Consulting Services you must be at least 18 years old and have full legal capacity.
- You understand that Commercial or other use of the Nagomi Consulting content for business (commercial) purposes is prohibited, unless expressly agreed in individual cases.
- You understand that the consulting services you will be receiving from Nagomi Consulting are not offered as a substitute for professional mental health care or medical care and are not intended to diagnose, treat or cure any mental health or medical conditions. You also understand that Nagomi Consulting is not acting as a mental health counsellor or a medical professional.
- You understand and agree that you are fully responsible for your well-being during your sessions, and subsequently, including your choices and decisions.
- You understand that Consulting is not a substitute for counselling, psychotherapy, psychoanalysis, mental health care or substance abuse treatment, and you will not use it in place of any form of therapy.
- You understand that all comments and ideas offered by Nagomi Consulting are solely for the purpose of aiding you in achieving your defined goals. You have the ability to give your informed consent, and hereby give such consent to Nagomi Consulting to assist you in achieving such goals.
- You understand the provision of services by Nagomi Consulting requires your co-operation. The decisive factor here is that you provide up-to-date, correct and complete information about yourself, your physical and psychological dispositions, dietary and exercise behaviour and other relevant self-observations during the coaching sessions.
- You understand that to the extent our work together involves career or business, Nagomi Consulting is not promising outcomes included but not limited to increased clientele, profitability and or business success.
- You understand the food and/or equipment recommended as part of your Program is not part of the Nagomi Consulting and must be purchased by you separately and at your own expense.
- You understand that Nagomi Consulting will treat your information as confidential unless you state otherwise in writing. If you report child, elder abuse or neglect or threaten to harm myself or someone else, you understand that necessary actions will be taken, and your confidentiality agreement limited in this capacity. Furthermore, if Nagomi Consulting is ordered by a court to provide information or to testify, and will do so to the extent the law requires.
- You understand that the use of technology is not always secure and you accept the risks of confidentiality in the use of email, text, phone, Skype and other technology.
- You understand you must pay attention to your body's signals. If you have any doubts about your health before or during the first session, always consult your doctor before starting or continuing with the coaching programme.
- You understand consultation appointments must be cancelled at least 24 hours in advance, otherwise they are binding and subject to a charge. In this case, Nagomi Consulting reserves the right to charge you the full cost of the session.
- You understand Life and health coaching is subject to constantly evolving research. Even if Nagomi Consulting is based on current studies and findings, it is not guaranteed that these correspond to the latest research results or findings.
- You understand that you are the utilisation of the services from Nagomi Consulting and are in association are taken at your own risk.
- You hereby release, waive, acquit, and forever discharge Nagomi Consulting, including its agents, successors, assigns, personal representatives, executors, heirs, and employees, from any and all claims, suits, actions, demands, or rights to compensation for damages that may arise from acts or omissions by myself or by Nagomi Consulting as a result of the advice provided by Nagomi Consulting or any outcomes from the coaching relationship as outlined in this agreement. Furthermore, you affirm that no promises, inducements, or agreements not stated in this agreement have influenced your decision to sign it. In this context, the utilisation of the services is at your own risk. This agreement shall be binding upon your heirs, executors, personal representatives, successors, assigns, and agents.
- You agree that all matters relating to your interactions on the site/application will be governed by the laws of the United States and the laws in the state of New York.
3. Payments and Refunds
- You may cancel an order within 24 hours of purchasing and request a refund. To cancel an order, send your request to info@nagomi-lifeharmony.com. You must clearly state the decision to cancel, the reason for said cancellation, and your preferred method of reimbursement if applicable.
- If you wish to alter or cancelled an appointment, this needs to be done at least 24 hours in advance, otherwise they are binding and subject to a charge. In this case, Nagomi Consulting reserves the right to charge you the full cost of the session.
- Reimbursement for refunds will be provided by the best available method, based on the Client’s situation and at the discretion of Grace Possible. A 5% transaction fee of the refund amount will apply and be subtracted from all refunds.
- If the Client cancels after beginning sessions and/or receiving services at Nagomi, they may only request a refund for the amount pertaining to remaining sessions not yet logged. The Client will not have the right to cancel or request a refund after the services have been fully performed (after all sessions or services have been completed).
- If you wish to alter or cancelled an appointment at least 24 hours in advance, otherwise they are binding and subject to a charge. In this case, Nagomi Consulting reserves the right to charge you the full cost of the session.
- We reserve the right to modify or terminate services and the Client-Company relationship at any time for reasons such as, but not limited to, dangerous or criminal behaviour on the part of the Client, inappropriate or offensive behaviour from the Client, or irresponsible or disrespectful behaviour from the Client. Nagomi Consulting will notify the Client with the reason for termination or modification and notice that it is effective immediately on the day that we contact the Client about modification or termination. In such situations, at the discretion of Dana Riedener, a refund may or may not be issued for any remaining sessions or services that were paid for but not completed.
- Should you fall into arrears with the payment of your invoices, Nagomi Consulting shall be entitled, following an unsuccessful reminder, to hand over the collection of the debt to an external debt collection agency. In this case, the external collection agency is liable to pay a fee and interest on arrears will be charged in accordance with the statutory provisions. Nagomi Consulting shall be entitled to terminate the contractual relationship with you.
